I'm 99.9% sure you have sub-surface rights - unless you gave them away YOURSELF, or bought the land after a previous owner gave them away - what state are u talking about.

When I bought property in rural Paulden Az 15 years ago, over one of the largest aquifers in North America, I had some of the best water you will ever taste from my well... But my deed clearly stated that I had absolutely no sub-surface rights...

Alaska, and allmost no one does unless they were greandfathered. It's a fact.
